Ravneet Kaur, Chairperson of the Competition Commission of India (CCI), raised critical issues surrounding digital platforms during the regulatory body’s annual day celebrations. She emphasized how the control of digital platforms over vast datasets can create barriers to entry for new players, affect platform neutrality, and potentially lead to algorithmic collusion.

Barriers to Entry and Platform Neutrality

Kaur highlighted the market concentration tendencies in digital markets, where network effects often lead to a scenario where one or two companies dominate the market. This dominance can create barriers to entry for competitors, hindering competition and innovation. Moreover, she pointed out concerns about platform neutrality, where platforms may favor their own services or products, posing challenges for fair competition.

Algorithmic Collusion: A Novel Challenge

Another significant concern raised by Kaur is algorithmic collusion, where algorithms implicitly coordinate prices or market strategies without explicit human direction. The opacity of algorithms makes it challenging to assess their impact on competition, posing novel challenges for regulatory bodies like the CCI.

Scrutiny Over E-commerce Platforms

During the event, the Attorney-General for India, R Venkataramani, highlighted the monopoly of e-commerce platforms over user data as an area for scrutiny. He suggested including the e-Commerce Policy in the government’s 100-day agenda to address concerns regarding the control and use of user data by e-commerce giants.

Draft National E-Commerce Policy: Long-Awaited Release

India’s draft National E-Commerce Policy, initially shared for public consultation in 2019, has yet to be finalized and released. The policy aims to bring stricter consumer protections and enforce data localization rules. However, concerns have been raised about the lack of updated drafts and public consultation.

Market Study on Artificial Intelligence (AI)

Kaur also announced that CCI is working on a market study on artificial intelligence (AI) to understand its implications for competition, efficiency, and innovation in key user industries. The study aims to develop a comprehensive understanding of the emerging competitive landscape and ecosystems driven by AI technologies.

Conclusion

The insights shared by Ravneet Kaur shed light on the complex challenges faced by regulatory bodies in digital markets. From barriers to entry and platform neutrality to concerns about algorithmic collusion and the need for robust e-commerce policies, these issues are crucial for ensuring fair competition and innovation in the digital economy.
